By accessing or using CheckVisaDocs ("Service"), you agree to be bound by these Terms of Use. If you do not agree to these terms, please do not use our Service. CheckVisaDocs reserves the right to modify these terms at any time, and your continued use of the Service constitutes acceptance of any modifications.

2. Description of Service

CheckVisaDocs provides AI-powered and human expert document verification services for visa applications. Our services include:

  • AI Document Check: Automated analysis of visa documents for completeness and accuracy
  • Expert Review: Professional review by immigration consultants
  • Immigration Case Matching: Connecting users with qualified immigration lawyers

3. Third-Party AI Processing (OpenAI)

🤖 Important: Your documents are processed by OpenAI

By using our AI Document Check service, you acknowledge and agree that:

  • Document Sharing: Your uploaded documents (including passports, financial statements, employment letters, and other supporting documents) are transmitted to OpenAI's servers for AI-powered analysis
  • Processing Location: OpenAI may process your documents on servers located outside your country of residence
  • OpenAI's Policies: OpenAI's data usage is governed by their own terms of service and privacy policy, available at openai.com
  • No Permanent Storage: According to OpenAI's API data usage policy, data submitted through the API is not used to train their models and is retained only for a limited period for abuse monitoring
  • Consent: By uploading documents and clicking "Check", you explicitly consent to sharing your documents with OpenAI for analysis purposes

If you do not agree to share your documents with OpenAI, please do not use the AI Document Check feature. You may instead opt for our Expert Review service, which uses human consultants only.

4. Not Legal Advice

CheckVisaDocs is NOT a law firm and does NOT provide legal advice. Our AI and consultant reviews are informational services designed to help you identify potential issues with your documents. The information provided should not be construed as legal advice, and we strongly recommend consulting with a qualified immigration attorney for legal matters. We do not guarantee visa approval or any particular outcome from immigration authorities.

5. User Accounts

To use our Service, you must create an account. You agree to:

  • Provide accurate and complete registration information
  • Maintain the security of your account credentials
  • Promptly notify us of any unauthorized account use
  • Accept responsibility for all activities under your account

6. Document Submission & Storage

When submitting documents to our Service, you represent and warrant that:

  • You own or have the right to submit all documents
  • All documents are authentic and not fraudulent
  • You will not submit documents containing malicious code or viruses
  • The documents do not violate any laws or third-party rights

Document Storage & Retention

By uploading documents, you acknowledge and agree that:

  • Storage Location: Your documents are stored in a private Amazon S3 bucket with encryption
  • Retention Period: Documents are automatically deleted 3 months (90 days) after upload
  • Manual Deletion: You may delete your documents at any time from your account Settings page
  • Deletion Timeline: Manually deleted documents are permanently removed within 24 hours

7. Payment and Refunds

Payment is required before document review begins. Our pricing is as follows:

  • AI Document Check: $19 per application
  • Expert Review: $49 per application
  • Immigration Case: Free to submit (lawyer fees determined separately)

We offer a 7-day money-back guarantee. If you are not satisfied with our service, you may request a full refund within 7 days of purchase. Refund requests should be submitted to our support team.

8. Intellectual Property

All content, features, and functionality of the Service, including but not limited to text, graphics, logos, and software, are owned by CheckVisaDocs and protected by international copyright, trademark, and other intellectual property laws. You may not reproduce, distribute, or create derivative works without our express written permission.

9. Prohibited Uses

You agree not to use the Service to:

  • Submit fraudulent or forged documents
  • Violate any applicable laws or regulations
  • Attempt to gain unauthorized access to our systems
  • Interfere with or disrupt the Service
  • Use automated systems to access the Service without permission
  • Engage in any activity that could harm CheckVisaDocs or other users

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, CHECKVISADOCS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, OR VISA DENIAL, ARISING FROM YOUR USE OF THE SERVICE. OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT PAID BY YOU FOR THE SERVICE IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM.

11. Indemnification

You agree to indemnify and hold harmless CheckVisaDocs, its officers, directors, employees, and agents from any claims, damages, losses, or expenses arising from your use of the Service, violation of these Terms, or infringement of any third-party rights.

12. Third-Party Services

Our Service may connect you with third-party immigration lawyers. CheckVisaDocs is not responsible for the services, advice, or actions of these third parties. Any engagement with third-party lawyers is subject to separate terms and agreements between you and the lawyer.

13. Service Availability

We strive to maintain continuous service availability but do not guarantee uninterrupted access. We reserve the right to modify, suspend, or discontinue the Service at any time without notice. We shall not be liable for any modification, suspension, or discontinuation of the Service.

14. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Delaware, United States, without regard to its conflict of law provisions. Any disputes arising from these Terms or the Service shall be resolved in the courts of Delaware.

15. Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.
